1. Parties

This agreement is between BENİMPOS BİLİŞİM TEKNOLOJİLERİ LTD. ŞTİ. ("BenimPOS") and the user who starts a monthly subscription on BenimPOS (the "Subscriber"). This agreement is an annex to the User Agreement. The User Agreement applies to matters not covered herein; on matters relating to the monthly subscription, this agreement prevails.

2. Subject

The subject of this agreement is the Subscriber's use of the BenimPOS Web, Mobile and Desktop applications under a subscription paid monthly instead of an annual license. The monthly subscription provides the same features as the annual license.

3. Fees and payment

The monthly fee is the VAT-inclusive amount shown when the subscription is started. The first payment is charged on the day the subscription starts, and subsequent payments are charged automatically to the Subscriber's saved card on the same day each month (or on the last day of the month if that day does not exist in that month). Payments are collected through iyzico Ödeme Hizmetleri A.Ş.; card details are stored by iyzico and are not stored by BenimPOS. An invoice is issued for each payment and sent to the Subscriber's email address.

4. Term and renewal

The subscription has no fixed term; it renews automatically each month until the Subscriber cancels it. Each successful payment extends the license by one month.

5. Cancellation

The Subscriber may cancel the subscription at any time, without giving a reason, from the "My Subscription & Payments" page. Cancellation stops the charges for the following months. The Subscriber may continue to use the service until the end of the month for which payment has been made; after that date, the account reverts to the free version. The data in the account is not deleted because of the cancellation; the retention terms are as set out in the User Agreement.

6. Refunds and right of withdrawal

No refunds are made for monthly subscription payments. The fee for a month that has been paid for is not refunded, even if that month has been used only partially or not at all, or the subscription is cancelled. Also where the Subscriber qualifies as a consumer, the right of withdrawal cannot be exercised under Article 15 of the Regulation on Distance Contracts, since performance of the service begins electronically at the moment of payment and the Subscriber consents to performance beginning immediately. The refund terms that apply to annual licenses do not apply to the monthly subscription.

7. Failed payments

If payment cannot be collected from the card, the Subscriber is notified by email, SMS and in-app notification, and the saved card is charged again over the following days. The Subscriber may change the card from the "My Subscription & Payments" page. The license is not extended for as long as payment cannot be collected; when the license term expires, the account reverts to the free version.

8. Price changes

BenimPOS may change the monthly fee. The new fee is notified to existing subscribers by email at least 30 days in advance and applies from the first billing period after this notice period ends. A Subscriber who does not accept the new fee may cancel the subscription within this period.

9. Switching to an annual license

The Subscriber may purchase an annual license at any time. When an annual license is purchased, the monthly subscription ends automatically and no charges are made in the following months. Monthly fees paid previously are not refunded and are not credited against the annual fee.

10. Acceptance and records

The Subscriber accepts this agreement electronically when starting the subscription. The date, time and IP address of the acceptance and the version of the agreement are recorded.

11. Disputes

Disputes arising from this agreement are governed by the laws of the Republic of Türkiye; the Ankara Courts and Enforcement Offices have jurisdiction. Where the Subscriber is a consumer, the Subscriber's right to apply to the competent Consumer Arbitration Committees and Consumer Courts under Consumer Protection Law No. 6502 is reserved.
